{"id":1187,"date":"2023-02-03T05:57:34","date_gmt":"2023-02-03T05:57:34","guid":{"rendered":"https:\/\/dehadrai.in\/?p=1187"},"modified":"2023-02-03T06:30:08","modified_gmt":"2023-02-03T06:30:08","slug":"6-case-against-live-streaming-of-classroom-footage-privacy-and-constitutional-law","status":"publish","type":"post","link":"https:\/\/dehadrai.in\/index.php\/2023\/02\/03\/6-case-against-live-streaming-of-classroom-footage-privacy-and-constitutional-law\/","title":{"rendered":"Case against live-streaming of classroom footage (Privacy and Constitutional Law)"},"content":{"rendered":"\n<p><a href=\"https:\/\/www.newindianexpress.com\/cities\/delhi\/2022\/feb\/22\/hc-asks-delhi-government-to-respond-to-plea-challenging-decision-to-install-cctv-cameras-in-classroo-2422550.html\">We are representing<\/a>, pro bono, the Delhi Parents Association and the Government School Teacher\u2019s Association, in a Public Interest Litigation (PIL) before the Delhi High Court.<\/p>\n\n\n\n<p>This is a writ petition challenging the Delhi Education Department\u2019s decision to livestream video footage of children and teachers to outsiders, <a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/installation-of-cctvs-in-classrooms-without-consent-violates-right-to-privacy-pil-before-delhi-hc-7785982\/\">without obtaining consent<\/a>.<\/p>\n\n\n\n<p>The Education Department, without any scientific research to study the impact of constant surveillance on young children, hurriedly decided to install 149,000 cameras inside thousands of classrooms in Delhi. We succeeded in having the case admitted for hearing on 22<sup>nd<\/sup> February 2021<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> and the next date of hearing in this case is 30<sup>th<\/sup> March,2022.<\/p>\n\n\n\n<p>Our case concerns \u2018the right to privacy\u2019 of both, children and teachers, to not have their day broadcast to outsiders, <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/delhi\/parents-can-now-access-cctv-feed-from-govt-schools\/articleshow\/89672979.cms\">especially in the absence of a data protection regime in India<\/a>.<\/p>\n\n\n\n<p>Furthermore, the right to privacy was upheld as a fundamental right under the Indian Constitution by the Supreme Court in a landmark 9-bench decision K.
