Constitutional Challenge to the imposition of Goods & Services Tax (GST) on disability aids (Supreme Court of India – Constitutional & Disability Law)

Perhaps one of our most important on-going pro bono constitutional cases.

We represent Paralympic Gold-medallist Manasi Joshi (she was on the cover of Time Magazine) pro bono in the Supreme Court, challenging the constitutionality of a taxing provision which imposes 5% tax levy on disability aids – such as prosthetic limbs, wheelchairs, braille paper etc.

This tax impacts millions of disabled individuals in India, who are effectively being penalized for their disability. We explained to the Court that taxing a person who walks with the aid of a prosthetic limb or a wheelchair, was akin to taxing an able bodied person for walking. We succeeded in getting Court Notices issued to the Union of India and the Ministry of Finance, and the case is now awaiting final arguments.
